2004 was a tumultuous time for Van Halen. Two failed reunions with David Lee Roth, and Michael
Anthony had been out trying to pick up other gigs, and started a hot sauce line. Sammy Hagar had
been a great resource for him, and he had began touring with Sammy and putting bands together.
So the fabled 2004 tour, which was a train wreck, rested in the hands of Sammy Hagar to make it
work. Sammy agreed that he wouldn’t tour if Michael wasn’t involved, so an agreement was put
together that Michael would tour, but waive his royalties for the time being with Van halen, just for
that tour. A lot of speculation has occurred over the years, as to whether the agreement was
perminant, but I believe it was not. And that as of today in some form Michael Anthony still holds
the rights to Van Halen music.
The initial agreement shown above was never enforced by Van Halen, and I think it was because Alex never wrote a thing, and just played on the albums once the music was created. If
Anthony had to take a cut then, Alex would eventually as well, as he wasn’t an equal member of
the band. So Eddie and Roth never enforced the above agreement. And when Sammy came publishing was split four ways.
